On 31st December 2025, the China Securities Regulatory Commission (CSRC) has formulated the “Implementation Measures for Securities and Futures Market Supervision and Management Measures” (Implementation Measures), which will come into effect on June 30th, 2026.

The Implementation Measures consist of 25 articles , mainly including the following

  • First, it clarifies the types of regulatory measures. It lists 14 commonly used measures, such as ordering rectification, regulatory interviews, issuing warning letters, and ordering periodic reports, and includes “other supervisory and management measures stipulated by laws, administrative regulations, and rules of the China Securities Regulatory Commission” as a catch-all provision.
  • Second, it clarifies the principles for implementing regulatory measures. The implementation of regulatory measures should adhere to the principles of legality, efficiency, and fairness; it should comply with the procedures stipulated by laws, administrative regulations, and rules of the China Securities Regulatory Commission; it should promptly correct illegal acts, prevent the spread of risks and harmful consequences, adhere to the combination of risk prevention and education , and be based on facts, commensurate with the nature, circumstances , degree of harm , and magnitude of risk of the act.
  • Third, it clarifies the procedural requirements for implementing regulatory measures. This includes general procedural requirements such as evidence collection, decision-making, service, on-site enforcement, recusal, and legal review; special procedural requirements such as prior notification; and rapid response mechanisms in emergency situations.
  • Fourth, it clarifies the requirements for making and executing regulatory measure decisions. This includes the matters that should be included in the regulatory measure decision document, disclosure requirements, and service procedures.
