On 7th September 2026, the Securities and Exchange Commission (SEC) proposed amendments to the annual fee criteria for securities and derivatives business operators (business operators) to align with current circumstances and further promote equality and fairness.

Earlier, the SEC revised the principles relating to the annual fee criteria for business operators to align with current circumstances and further promote equality and fairness. The SEC subsequently conducted a public hearing on such principles during June–July 2026, in which the majority of relevant parties agreed with the proposed principles.

The SEC has accordingly prepared a draft notification in line with the afore mentioned principles and is seeking public comments on the draft notification. The key amendments are as follows:

  • Increasing the fee rate for investment advisory businesses from 25,000 baht to 50,000 baht per year, and commencing the collection of fees for derivatives dealer businesses at the rate of 50,000 baht per year;
  • Revising the fee calculation base for investment unit dealers to include the value of investment unit purchases, and expanding the fee calculation base for derivatives agents to cover transactions on foreign derivatives exchanges and over the counter (OTC) derivatives;
  • Increasing the maximum fee rates for securities and derivatives businesses to ensure that fee collection is appropriate, reflects supervisory costs, and further reduces disparities among business operators.
